Employer Representation
Employment law reaches nearly every decision a company makes about its people. We advise employers at each stage of the employment relationship, from hiring through separation, and we defend them when disputes arise.
Counseling and Compliance
Most employment disputes can be traced to a decision that was made without advice or a document that was never put in writing. We help employers put sound practices in place before a problem develops. Our counseling work includes:
- Employment agreements and independent contractor agreements
- Personnel policies and employee handbooks
- Confidentiality and non-compete agreements
- Advice on hiring, termination, and severance decisions
- Wage and hour compliance under the Fair Labor Standards Act and the Texas Payday Law
- Family and Medical Leave Act administration and disability accommodations under the ADA
- Wage and hour audits and worker classification reviews
- Co-employment and staff leasing arrangements
- Workers' compensation issues for subscribers and nonsubscribers
- OSHA compliance and investigations
- Employment practices training for managers and supervisors
Employment Litigation and Agency Proceedings
When a charge or lawsuit is filed, we defend the employer through investigation, discovery, hearing, and trial. We also pursue claims on behalf of employers, most often against former employees who have violated restrictive covenants or taken confidential information. Our litigation work includes:
- Defense of EEOC and Texas Workforce Commission charges
- Discrimination and harassment claims under Title VII, the ADEA, the ADA, and the TCHRA
- Non-compete and confidentiality disputes, including temporary restraining orders and injunctions
- Breach of contract and breach of fiduciary duty claims
- Tortious interference with customer and employee relationships
- Workplace injury defense
- NLRB proceedings, including disputes over picketing, handbilling, and boycotts
- Union arbitrations on behalf of management
